Can a foreigner buy property in Panama?
Yes. Panamanian law allows foreign nationals to acquire and hold titled real estate on essentially the same terms as Panamanians. Restrictions and special regimes apply to certain areas — border zones and some coastal and island land, which in many cases is held under concession or possessory rights rather than title — so we verify the status of each property before any offer is made.
What does property due diligence include?
A Public Registry certificate on ownership and encumbrances, review of mortgages, attachments and easements, property tax standing, land use and applicable permits, the regulations and fees if the property sits under the Horizontal Property Regime, and verification of the developer and the project for pre-construction purchases.
Should I buy in my own name or through a company?
It depends on the use of the property, on your estate and succession planning and on the tax treatment that applies to you. It is a decision to make before signing the promise-to-purchase, and we assess it together with our corporate practice.
Do you work with BROKRS on the real estate side?
Yes. BROKRS is the real estate agency in the same group: it handles the real estate service — search, valuation and negotiation — while KRLegal provides legal support at every step: due diligence, contracts, deeds and transaction tax advice.
